The Bragg indictment of former President Trump on the flimsiest grounds continues to reverberate across the body politic. Five more thoughts:

1: At the beginning of Mr. Trump’s tenure as the forty fifth president of the United States, Senate Majority Leader, Democrat Chuck Schumer, gave the newly elected President Trump some advice that, in retrospect, was prophetic. Schumer warned Trump to be careful about going up against the entrenched Washington bureaucrats and legislators (sometimes called the “deep state” and sometimes, even the “swamp”), because, as Schumer put it: “They’ll come after you six ways from Sunday.” Truer words have never been spoken. As everyone knows, however, Trump paid little heed to Schumer’s warning. Staying true to his campaign promises to “drain the DC swamp,” President Trump forged his own way forward and did take on the “deep state,” at least partially. And, just as Schumer predicted, the swamp did come after him with a vengeance. From Inaguration Day on, Mr. Trump faced an onslaught unprecedented in the history of American presidential politics. The Bragg indictment is merely the latest chapter.

2: When I first considered Trump’s indictment, I must admit that I was more cavalier about it than I should have been. I had assumed that, although the case against him was weak, if somehow he was given a guilty verdict, Mr. Trump would have several “ways out.” I thought that, for example, if Trump was convicted, but was elected again to the Presidency, he could pardon himself. Alternatively, if DeSantis or some other Republican were elected, they could pardon Mr. Trump. WRONG on both accounts! It turns out that an American President CANNOT pardon anyone convicted on a State charge. Alternatively, I thought that, if convicted, Trump could appeal the verdict to the Supreme Court, at which point the conservative majority would acquit him. WRONG again! It turns out that the Supreme Court does NOT decide on the guilt or innocence in a given case, and does NOT acquit. They can send the case back for RETRIAL if they feel that there has been a breach of constitutional procedure, but can’t do so because they just don’t like the result. In other words, although Bragg’s case against Trump is VERY WEAK, should Bragg obtain a guilty verdict (New York City juries are among the most left wing, and, by extension, most anti Republican, in the nation), Mr. Trump would be in serious legal jeopardy. Rikker’s Island is no place for a “law and order” stalwart. All of this MUST have been explained to him by his legal team. It is a testament to Trump’s courage that he has committed himself to fighting the indictment to the “bitter end” if necessary. And the investigations going on in Washington for mishandling records (18 U.S.C. Section 2071b), “inciting an insurrection,” and, in Georgia, “attempting to overturn an election,” might be stronger. So far, he’s instructed his legal team not to even consider plea bargaining strategies. You’ve got to admit, he’s tough as nails.

3: There’s no end to Alvin Bragg’s novel legal theories. In addition to his trying to stretch misdemeanor statues (with minor penalties) into felonies (with major punishments) by insinuating “other crimes were committed” and then NOT EVEN SPECIFYING WHAT THOSE ALLEGED CRIMES WERE, and then trying to exert State’s jurisdiction over campaign violations that would be FEDERAL NOT STATE CRIMES, Bragg has come up with another lollapalooza: he wants to sue Congressman Jim Jordan (R-OH), who, along with a Congressional Committee, is investigating HIM for prosecutorial misconduct. Well, that’s certainly a new strategy! Had Bragg’s legal theories been available to Richard Nixon, for example, Nixon would have been able to sue Special Prosecutor Archibald Cox for “interfering” with his Presidency over a little matter called “Watergate!” Likewise, Bill Clinton would have been able to sue Special Prosecutor Kenneth Star over his (Clinton’s) own perjury regarding Monica Lewinsky (“I did not have sex with that woman.”) , White Water, and Madison Guaranty Savings and Loan failure. And, again, Ronald Reagan could have sued Special Prosecutor Lawrence Walsh over “Iran Contra.” I guess all of these Presidents and their legal teams JUST WEREN’T AS SMART as Mr. Alvin Bragg.

4: Although Bragg was not involved in the shocking case of a recent murder in NYC, I’d like to mention the case because it exemplifies the sad state of “criminal justice” in today’s New York City in which leftist prosecutors like Bragg and his ilk, operate. Earlier this week a perpetrator by the (unlikely) name, Messiah Nantwi, was arrested for an “execution style” murder, caught on surveillance video in a Manhattan smoke shop. Shockingly, it turns out that Nantwi had murdered ANOTHER individual less than 24 hours before. Even more shocking is the fact that Nantwi had been arrested in February of 2021 for SHOOTING AT LEAST THREE ROUNDS DIRECTLY AT POLICE when he was being arrested for graffiti vandalism! And what’s even more shocking than that is, after he was apprehended, he was then RELEASED OUT ON BAIL! Yes, you read that right: after directly shooting at police officers, Nantwi was released OUT ON BAIL! Free AGAIN to prowl the streets of Manhattan committing murder and mayhem! This derelict system of “justice” in NYC is the milieu in which Alvin Bragg and other leftist district attorneys work.

5: The precedents set by Bragg and the several other anti Trump “investigations” currently underway is something the Democrats themselves ought to be very concerned about. It is within the realm of possibility that their current strategy could backfire and could be USED AGAINST THEM by Republican prosecutors is any number of jurisdictions. Among those in serious jeopardy would be the Biden crime family, son AND father (for extortion, money laundering, Hatch Act violations, and more, all of which are felonies), Hillary Clinton (doing government work on an unsecured and illegal server, money laundering, illegal quid pro quo, deleting 30,000 emails UNDER SUBPOENA all of which are felonies), James Comey (illegal leaking of classified information, that he ADMITTED TO, and is a felony), Nancy Pelosi (insider trading, a felony) and many others. The dangerous precedents set by the anti Trump Democrat adversaries, brings to mind a wise old saying that Democrats should carefully consider: “Be careful what you wish for.”
