A Debacle Of Their Own Making
James Comey does not, apparently, like to be out of the limelight for long. I was surprised yesterday when Mr. Comey was interviewed on CBS as a guest commentator regarding accusations made by Dr. Christine Blasey Ford against Supreme Court nominee, Brett Kavanaugh. I was even more surprised when, in that interview, he threw cold water, albeit somewhat grudgingly, on the current Democratic Party’s strategy for delaying Judge Kavanaugh’s appointment.
When asked if it was proper for Judge Kavanaugh’s accuser (Dr. Ford) to demand an FBI investigation into her allegations, Comey replied that there were only two types of FBI investigations: 1. Investigations into criminal activity. 2. Background checks of individuals being considered for government positions. He went on to say, that in the case of the accusations against Judge Kavanaugh, criminal investigations wouldn’t apply and that, having already completed an exhaustive background check on Judge Kavanaugh, the only way the FBI could reopen their investigation would be as a “follow up” background check, and they would do this ONLY at the request of the government agency doing the appointing, which, in this case, is THE WHITE HOUSE! The clear implication was, that because there is no crime involved (more on that below) the agency would NOT initiate expanded background checks at the request of Dr. Ford, Chuck Schumer, Diane Feinstein, Maxine Waters, Rachel Maddow, or anyone else. Since the White House is the agency appointing Kavanaugh, the request for further investigation can only come from them.
Now, the protocol of limiting background checks to those done for governmental agencies considering a governmental appointment, is, in my opinion, pretty straight forward, and pretty much what I would expect the proper protocol to be. What surprised me was the implication that this case was NOT a criminal matter. How so, I wondered? Could it be that this would be a statute of limitations case?
Doing a bit of research, I learned that the State of Maryland has NO Statute of Limitations on felonies, so you would think that it would be possible for Dr. Ford to, rightfully, demand a criminal investigation. BUT, here’s the thing: the actions she alleged in her letter to Senator Feinstein would be considered misdemeanors, and, as such, WOULD be subject to Statues of Limitations constraints, and these would have expired long ago. This is why Comey answered the question as he did. It’s simply far too late for Dr. Ford to accuse Judge Kavanaugh of a crime, and, as a consequence, there is no scenario in which Dr. Ford or the many other denizens of the “resistance” can force FBI involvement.
In the meantime, a second individual named by Dr. Ford as being present at the party, Patrick Smyth, has come forward and denied Ford’s claims. In a letter he sent to the Senate Judiciary Committee he stated that he had no knowledge of the party Ford described in her letter, nor did he have knowledge of any improper conduct on the part of Judge Kavanaugh at any time.
Smyth’s letter corroborates a similar response from the other person Ford named as having been present in the room during the alleged assault, Mark Judge. Mr. Judge, in a letter sent yesterday to the Senate Judiciary Committee, states that “He never saw Brett (Kavanaugh) act in the manner Dr. Ford describes.”
And, on top of all this, Dr. Ford’s startling refusal to testify at the Judiciary Committee has further undermined her credibility.
So, in the face of all this, I think the American public is beginning to catch on. More and more, fair minded Americans are seeing this whole affair for what it is: a bold faced deception by the Democrats and “progressives” designed to stop the appointment of a well chosen, highly qualified candidate that has been nominated and vetted by all of the established rules and procedures set forth in the Constitution, simply because he’s a conservative. And, even though the Democrats won’t ultimately be able to stop the appointment, I think that part of their strategy is that, even if they lose the battle, they can use the Kavanaugh appointment as a rallying cry to try to whip up waning enthusiasm for their party come Election Day in November. With the economy doing so well and with things also improving on the international front, they are dreadfully afraid that the “blue wave” they have been hoping for will fizzle as Americans realize that, despite the unconventional and quirky methods of our President, both he and our Republican representatives have been quite good for America, and should be kept in control. So, dear readers, if you agree, please talk this up. People “on the fence” need to see the nefarious tactics of the Democrats and “progressives” described above for what they really are. Let’s deprive them of the PR bonanza that they are hoping to salvage from a debacle of their own making.
